here whether similar provisions have been included in contracts in Malaya or elsewhere but nevertheless it is considered that inclusion of such clause would be imprudent because it will create a precedent which will be extremely difficult to resist, not only in Hong Kong but also in other Colonies, and particularly with regard to Service Departments' contracts in which contractors would undoubtedly press for inclusion of similar provisions.
As the future of Kai Tak is still uncertain pending report of survey party referred to in my telegram No. 578 the disadvantages of the proposal seem to make it impolitic to accept the Company's condition. In the circumstances I am reluctant to agree to the proposal particularly as it is not the type of liability which His Majesty's Government is prepared to underwrite paragraph 4 of your telegram
